• All Products are for laboratory research and development use only.
• Products are not for human or animal consumption of any kind.
• The statements on this website have not been evaluated by the U.S. Food and Drug Administration.
• Products are not intended to diagnose, treat, cure, mitigate, or prevent any disease, ailment, or medical condition.
• ELEV8 is a research chemical supplier, not a compounding pharmacy, chemical compounding facility, or outsourcing facility as defined under Sections 503A or 503B of the Federal Food, Drug, and Cosmetic Act.

All Products are sold strictly for research, laboratory, and analytical purposes. Products may not be used for:

• Human or animal use or consumption of any kind
• Clinical, diagnostic, or therapeutic purposes
• Food, drug, cosmetic, household, recreational, commercial, or medical applications

Buyer agrees that MATERIAL will not be used for human or animal consumption and will be handled only by qualified, properly trained research or laboratory professionals.

You must be at least 21 years of age to access this website and to purchase MATERIAL. By placing an order, Buyer represents and warrants that they are at least 21 years old.

Buyer represents and warrants that, through their own independent review and study, they are fully aware and knowledgeable about:

• The in-vitro research use of the Products;
• The health and safety hazards associated with handling the Products;
• The industrial hygiene controls necessary to protect personnel from such hazards;
• The need to adequately warn of health and safety hazards associated with the Products; and
• All federal, state, local, and international government regulations regarding the use of and exposure to the Products.

Buyer warrants that they are affiliated with a laboratory, institution, university, or other research-based facility that warrants the purchase and use of Products for research purposes only. ELEV8 reserves the right to limit or deny sales to any individual it deems unqualified, and may require further verification of affiliation prior to fulfillment.

ELEV8 accepts payment via Zelle and USDC on the Solana network. All payments are made payable to ELEV8.

• Payment instructions are provided after an order is placed. Orders are processed only once payment is confirmed.
• Buyer is responsible for sending the exact amount shown and including the provided order number as a reference or memo where supported.
• Cryptocurrency payments are irreversible. Buyer is solely responsible for sending the correct amount of USDC on the correct network (Solana) to the correct wallet address. ELEV8 is not responsible for funds sent to an incorrect address or on an incorrect network.
• Any discount, including the crypto discount, is applied as described at checkout.

Receipt of an order confirmation does not constitute our acceptance of an order. ELEV8 reserves the right, at its sole discretion, to accept or decline any order for any reason, including limiting or canceling quantities purchased per person or per order. We may require additional verification or information before accepting an order. If we cancel an order after payment has been made, we will issue a refund for that order.

Prices, promotions, and availability are subject to change without notice. ELEV8 reserves the right to correct any inaccuracies or typographical errors in pricing, descriptions, or availability, and shall have no liability for such errors. If a Product is listed at an incorrect price or with incorrect information due to error, ELEV8 may cancel the affected order and, where payment has already been made, issue a refund.

All orders ship from within the United States, typically within 24 hours of payment confirmation, subject to availability. Shipping times are estimates only and are not guaranteed. ELEV8 is not responsible for carrier delays, customs delays, lost shipments, or other circumstances beyond our reasonable control. If an item is out of stock, we will notify you, and you may cancel the order before it ships.

Due to the sensitive nature of research materials, all sales are final. Please review our Refund & Return Policy for full details on damaged or incorrect order remedies and how to make a claim.

In no event shall ELEV8 be liable for any incidental, special, consequential, or indirect damages, whether Buyer's claim is in contract, negligence, strict liability, or otherwise. ELEV8 assumes no legal responsibility for the improper handling, storage, or use of MATERIAL. ELEV8 is not liable for any damages caused by negligence, abuse, misuse, or any other unforeseen matter arising from Buyer's possession or use of the Products.

In direct consideration of approving the sale of any Product to Buyer (which sale ELEV8 would not otherwise make), Buyer agrees to indemnify and hold ELEV8 and its affiliates, officers, directors, agents, partners, and employees harmless from all claims, expenses, losses, and liabilities of any nature whatsoever arising out of Buyer's handling, possession, storage, and/or use of any Product, whether used alone or in combination with any other substance, or arising out of Buyer's violation of this Agreement or any rights of another.

Buyer understands and agrees that the Products have not been tested by ELEV8 for safety or efficacy, and are intended solely for qualified in-vitro research purposes. The Products and this website are provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability or fitness for a particular purpose. Buyer warrants that any material produced with any Product shall not be misbranded or adulterated within the meaning of the Federal Food, Drug, and Cosmetic Act, and shall not be introduced into interstate commerce in violation of that Act.

Buyer assumes responsibility to verify the hazards of the Products and to conduct any further research necessary to learn the hazards involved in their use. Buyer must warn all personnel involved (including freight and handling personnel), follow all applicable safety instructions and Safety Data Sheets, and ensure compliance with all federal, state, and local laws and regulations.

The listing of a MATERIAL on this website does not constitute a license to, or a recommendation for, its use in infringement of any patent. ELEV8 does not guarantee that the use or sale of any MATERIAL will not infringe upon any patent.

Unless otherwise stated, MATERIAL may not appear on the Toxic Substances Control Act (TSCA) inventory listing, as it is intended solely for in-vitro research purposes. Buyer assumes responsibility to ensure that any Products purchased are approved for use under TSCA, if applicable.

Buyer receives a limited, non-transferable right to use MATERIAL only for internal research. Without ELEV8's prior written approval, Buyer may not resell, supply, repackage, re-label, export, or otherwise transfer MATERIAL to any third party.

Unless stated otherwise, all content on this website, including text, design, structure, "look and feel," logos, graphics, icons, images, and code (collectively, "Content"), is owned, controlled, or licensed by ELEV8 and is protected by copyright, trademark, and other intellectual property laws. No Content may be copied, reproduced, republished, modified, posted, transmitted, or distributed in any way without ELEV8's express prior written consent. Unauthorized use may result in civil or criminal penalties.

This website may include links to third-party websites for convenience only. ELEV8 does not review, endorse, or control, and is not responsible for, the content, products, services, or privacy practices of any external site. Accessing any linked site is at Buyer's sole risk.

ELEV8 shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including without limitation backorders, mail or carrier delays, customs delays, lost shipments, acts of God, or interruptions to this website. ELEV8 is not obligated to notify Buyer in the event of such delays.

Buyer agrees not to post false, misleading, or defamatory information about ELEV8. Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts located in the State of Indiana, and Buyer consents to the personal jurisdiction and venue of those courts. Buyer agrees to bear all associated legal fees and costs to the extent permitted by law.

This Agreement and Buyer's use of this website are governed by and construed in accordance with the laws of the United States of America and the State of Indiana, without giving effect to any principles of conflicts of law.

If any portion of this Agreement is deemed or determined to be unenforceable, that portion shall be eliminated or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

This Agreement, together with our Privacy Policy and Refund & Return Policy (incorporated herein by reference), constitutes the entire agreement between ELEV8 and Buyer relating to the subject matter hereof and supersedes any prior understandings. ELEV8 may amend or update this Agreement at any time by posting the revised version on this page with an updated Effective Date. Continued use of this website or our services after changes are posted constitutes acceptance of the updated Agreement.
